Estimated Costs

Project estimates are valid for 30 days from the date of quotation. The project may be re-estimated if the designer determines the scope of the project has been altered from the originally agreed upon concept/brief given by the client.

Rush Work

There is a 20% extra charge for rush work (rush to be determined at the time of quote) and a 25% extra charge for rush work resulting in weekend work.

Payment Schedule

A deposit of 50% (non-refundable) of the total estimated cost is required prior to the execution of the project as well as printer’s costs, or license purchases for web extensions are required. Payment in full or the remaining balance is to be paid before delivery of the completed project. There is a finance charge of 2.2% p/month on all overdue balances. Prices can change without prior notice.

Pre-Purchased Design Time Blocks

Pre-purchased design time blocks are bought for 5, 10, 20 hours.

• The time it takes to complete design requests is debited from this block.
• There are priority turnarounds on projects/updates.
• Time debits are tracked in a spreadsheet detailing the design projects or updates.
• Time is calculated in increments of 5min.
• When the block of time reaches 1 hour or less, you will be contacted to purchase of an additional block.
• When a time block is complete and another block has not been purchased, you will be charged for the extra time used at the regular hourly fee.

Reproduction Of Work

The client assumes full reproduction rights upon full payment for the completed project. The designer retains personal rights to use the completed project and any preliminary designs for the purpose of design competitions, future publications on design, educational purposes and the marketing of the designer’s business. The client will be given any necessary credit for usage of the project elements if applicable.

Rejection/Cancellation Of Project

The client shall not unreasonably withhold acceptance of, or payment for, the project. If prior to the completion of the project, the client observes any non-conformance with the design plan, the designer must be promptly notified, allowing for necessary corrections.
Rejection of the completed project or cancellation during its execution will result in forfeiture of deposit and the possible billing for all additional labour or expenses to date. All elements of the project must then be returned to the designer. Any usage by the client of those design elements will result in appropriate legal action. Client shall bear all costs, expenses, and reasonable attorney’s fees in any action brought to recover payment under this contract or in which Eve M Designs may become a party by reason of this contract.

Completion/delivery of project

The client will assume any shipping or insurance costs. Any alteration or deviation from the above specifications involving extra costs will be executed only upon approval with the client. Any delay in the completion of the project due to actions or negligence of client, unusual transportation delays, unforeseen illness, energy failure, equipment breakdown or external forces beyond the control of the designer, shall entitle the designer to extend the completion/delivery date, upon notifying the client, by the time equivalent to the period of such delay. Where production schedules are not adhered to by the client, final delivery date(s) will be subject to renegotiation.

Websites will be staged, for proofing purposes, on the staging link (a link will be sent to website clients). Minor and reasonable changes may take place during this phase of the design. Any changes requested by the client to the agreed website concept and additional image sourcing will carry additional costs to the client. Only once final payment is received, the completed website will be loaded onto the World Wide Web according to FTP details provided by the client. The web client then has 5 working days from the uploading day to make minor changes and corrections, thereafter changes will be charged for at our update rates.

Liabilities

Eve M Designs is not held responsible for the use of images, fonts etc. upon the request of the client. If a client requests the use of copy written images or fonts or where it is stated that payment is required for the use of the particular object, they are liable for the costs incurred by the designers obtaining permission to use them or will not be held responsible should action be taken for the use of these objects.

Preparatory Materials

Preparatory work performed at the client’s request, such as sketches, concepts, drawings, composition, disks, plates, presswork, and materials etc. will be charged at current rates and may not be used without the consent of Eve M Designs.
Artwork, type, negatives, positives, plates, disks, and other items when supplied shall remain Eve M Designs’ exclusive property unless otherwise agreed in writing.

Project Changes

A total of 3 changes are allowed to a client for design projects. If more changes are requested, an hourly rate for these changes will be added to the total of the final invoice.

Proofs

A proof will be supplied and must be signed or accepted by the client. If revised proofs are desired, requests should be made when proofs are returned. A reasonable (5% -10%) variation in colour between colour proofs and the completed print job shall constitute acceptable delivery.
Eve M Designs cannot be held responsible for errors under either or both of the following conditions;
• If the customer has failed to return final proofs with indication of changes and corrections
or
• If the customer has instructed Eve M Designs to proceed without submission of proofs.
Any changes made after the proofs are signed off, approved or accepted will incur extra costs depending on existent of changes.
